This privacy policy explains how Undecided Media, LLC ("we", "us" or "our") collects, uses and shares your information, and the choices you have.

Who this policy covers

This policy applies to all websites and services run by Undecided Media, LLC, including:

undecided.tech (Undecided with Matt Ferrell)
stilltbd.fm (Still To Be Determined)
trekintime.show (Trek In Time)
undecided.media
academy.undecided.tech (our online courses)

It also covers our email newsletters, member accounts, private podcast feeds for paying members, and course purchases.

It does not cover other platforms we use to publish our shows, such as YouTube, Patreon, and podcast apps. Those platforms have their own privacy policies.

Undecided Media, LLC is the data controller for the information described here. That means we decide how it is used.

What information we collect

Information you give us

Account details. Your name and email address when you create an account, subscribe to a newsletter, become a member, or buy a course.
Membership and purchase details. Your membership tier, sign-up date, payment status, and which courses you have bought.
Messages. What you send us through a contact form or by email, including your name and email address.
Comments. Anything you post in comments on our sites, together with your name.

Information we collect automatically

Technical information. Our servers record information such as your IP address, browser type, device type, and the pages you request. We use it to run and protect the sites.
Newsletter activity. When we send a newsletter, our email system records whether it was delivered, and whether it was opened or a link was clicked. This helps us see what readers find useful.
Visitor statistics. We count visits and page views to understand which pages and episodes people use. These statistics are counted as totals and do not identify you, and the tool we use does not set cookies.
Cookies. See the cookies section below.

Information from other companies

Stripe tells us whether a payment succeeded, along with limited billing details such as your country. We never see or store your full card details.
Patreon. If you support us on Patreon, Patreon shares your name, email address and membership tier with us. We use this to create a member account for you on our website, so you can sign in, and to add you to our newsletter. You can unsubscribe at any time. In the future, we may use your tier to give you other supporter benefits on our websites.

We do not buy information about you from data brokers, and we do not collect sensitive personal information.

How we use your information

To run our websites and services, and to manage your account
To provide your membership or course, and to process payments
To send the newsletters you subscribed to
To send service emails you need, such as sign-in links, receipts, and account notices
To reply to your messages
To thank supporters, for example by reading supporters' names in a show. If you do not want your name read out, contact us.
To understand how our sites are used and improve them
To keep our sites and accounts secure, and to prevent fraud, spam, and abuse
To meet our legal obligations, such as keeping tax records
To manage business transfers, such as if our business is sold, merged, or restructured

Cookies

Cookies are small files placed on your device. We use them to keep you signed in, to remember your cookie choices, and to make embedded players work. Embedded YouTube videos, podcast players, and course videos can set their own cookies.

Do Not Track

Some browsers have a "Do Not Track" setting that sends websites a signal asking not to be tracked. There is no common standard for how websites should respond to this signal, so our sites do not change their behavior when they receive one. You can control cookies at any time with the cookie banner, or in your browser settings.

We do not sell your personal information, and we do not share it for targeted advertising.

We share information only in these cases:

1. Service providers. We use trusted companies to run our services. They may process your information only on our instructions, and only to provide their service to us:

Stripe, to process payments
Mailgun, to send newsletters and account emails
Hostinger, which hosts our websites and their databases (we run the Ghost website software ourselves)
Transistor, to deliver private podcast feeds to paying members
Acast, which hosts our public podcast episodes and measures listens
Vimeo, which hosts our course videos and members-only videos, such as ad-free episodes
Web3Forms, which delivers messages sent through our contact forms
CookieYes, which runs our cookie banner and records your cookie choices
Notion, where we keep internal records, such as our list of Patreon supporters for on-air thank-yous
Backblaze, which stores encrypted backup copies of our websites and databases in case of a failure

2. With your consent. When you ask us to, or agree to it.

3. Legal reasons. When the law requires it, such as a court order or subpoena, including requests from public authorities to meet national security or law enforcement requirements. We may also share information to protect our rights or the safety of others.

4. Business transfers. If our business, or part of it, is sold, merged, or restructured, your information may pass to the new owner. They must continue to protect it in line with this policy.

How long we keep your information

Account and membership information: for as long as you have an account with us.
Payment and purchase records: for as long as tax and accounting laws require, usually about 7 years.
Messages you send us: for as long as we need them to deal with your message, and for a reasonable time after.
Comments: until you or we delete them, or until your account is deleted.
Server logs: for a short time, for security and troubleshooting.

When we no longer need your information, we delete it or make it anonymous. Backup copies are kept for up to 12 months, then deleted.

How we protect your information

We take reasonable steps to protect your information, such as encrypted connections (HTTPS), limited access, and regular backups. No website or storage system is completely secure, so we cannot guarantee absolute security.

Your choices and rights

Wherever you live, you can:

Unsubscribe from any newsletter with the link at the bottom of each email, or in your account settings on the website
View or update your account details by signing in to the site
Delete your account by signing in, or by asking us
Ask us for a copy of the information we hold about you, or ask us to correct or delete it
Change your cookie choices at any time with the cookie banner

To make a request, contact us using the details below. We may need to confirm your identity first. We will reply within 30 days.

Extra information for visitors in the EU and UK

Legal bases. Under the General Data Protection Regulation (GDPR) and UK GDPR, we must explain the legal reasons we use your information:

Contract. To provide your account, membership, or course.
Consent. For newsletters you sign up to, and for non-essential cookies. You can withdraw your consent at any time.
Legal obligation. For example, keeping payment records for tax purposes.
Legitimate interests. To keep our sites and accounts secure, to prevent fraud and abuse, to fix technical problems, to send service emails, to understand how our sites are used, and to add Patreon supporters to our newsletter. You can object to this use at any time.

Your rights. You also have the right to:

receive your information in a common format and have it sent to another organization
restrict how we use your information in some situations
object to our use of your information based on legitimate interests
complain to the data protection authority in your country

International transfers. We are based in the United States, and our service providers process data in the United States and other countries. Where information is transferred from the EU or UK to a country without an "adequacy decision" from the European Commission or the UK government, we rely on appropriate safeguards. Our main service providers are certified under the EU-U.S. Data Privacy Framework, or use Standard Contractual Clauses approved by the European Commission.

Automated decisions. We do not make decisions about you based only on automated processing.

Extra information for US residents

Some US states, such as California, give residents extra privacy rights, including the right to know what information a business holds about them, and to ask for it to be corrected or deleted. We honor these requests from everyone, wherever you live. See "Your choices and rights" above.

We do not sell your personal information, and we do not share it for targeted advertising. We will not treat you differently for using your privacy rights.

Children

Our services are not directed at children under 16, and we do not knowingly collect personal information from them. If you are a parent or guardian and believe that your child has given us personal information, please contact us and we will delete it.

Links to other websites

Our sites link to other websites, apps, and services, such as podcast apps, YouTube, and Patreon. We do not run them, and this policy does not cover them. Please read their privacy policies before you give them any personal information.

Changes to this policy

We may update this policy from time to time. We will change the effective date at the top of this page when we do. If we make an important change, we will tell members by email before it takes effect.
